Delivery & Pick-up Policies

1. Principle

The timely provision of goods and the associated reliable supply to customers has always been of great importance and will gain in this, as a result of the ever increasing competitive pressure.
The quality of logistics has always, but also increasingly, determined competitiveness and is increasingly becoming an important success factor. That for, the continuously increasing requirements lead to the need of a continuous improvement of the processes and the cooperative partnership between Alfred Neudert GmbH (hereinafter referred to as Neudert) and the delivering or picking up companies or transport companies. To ensure smooth and safe operation, it is imperative to comply with the requirements. The following delivery specifications are binding as supplementary agreements to our general terms and conditions (AGB, BGB, HGB, ADSp)

3. General 
3.1. company language 

The company language and the business language at Neudert is German. The documentation carried out by the transport company and all negotiations are written or conducted in German.
Signs and boards on the company's premises are written in German. All Neudert employees communicate exclusively in German. This prevents possible discrimination against other groups. Everyone is measured by the same standards and communicates in the same language.
The employees employed by the transport company are able to read and understand signs and signs on the company premises. The carriers can communicate with the Neudert employees as required. This is the only way to ensure the smooth flow of goods.
If a transport company incorporates a new employee, we are happy to support you by communicating with these employees on an agreed basis in accordance with our rules. Nobody should be disadvantaged here, everyone can be a valued member of our society.

3.2. Applocable law 

Only German law under the Committee on UN Sales Law (CISG) applies to this agreement.

3.3. Jurisdiction 

The place of jurisdiction for all legal disputes arising from this agreement is, as far as permissible, Würzburg.


4. Receipt of goods (the transport company delivers goods
4.1. Receiving hours

 

The following delivery times apply:
monday – friday: 07:00 – 9:00, 9:15 – 12:00 and 12:45 – 18:00

4.2. Place of delivery 

The place of goods receipt is in the right rear hall. At the gate there is a sign "Wareneingang", as well as a bell for ringing. The entrance (door) is on the right around the corner.

4.3. Procedure if the place of delivery is not staffed 

Someone can always be reached at the Neudert company during the specified times.
If the place of delivery are not staffed, please go to the place of pick-up. There is also a bell that you can ring. In the unlikely event that no one reacts, please go to the main entrance. The “visitor bell” is located in the foyer in front of the glass door.

4.4. Authorized persons 

Employees of Neudert can be identified by the fact that they are wearing a gray Neudert shirt and have a blue transponder.
Only Neudert employees are authorized to accept consignments. Upon request from the carrier, each employee is happy to identify himself with his shirt and transponder. People who only have the gray shirt or only the blue transponder or neither of them are not employees of the Neudert company.
All other people, whether inside or outside the company premises, even if they pretend to be employees of the Neudert company, may not receive any goods from the transport company. In this case, the shipment is considered "not delivered" and it is still the responsibility of the transport company to deliver this shipment to Neudert on time.

4.5. documentation of goods receipt 

The transport company has document-correct procedures for documenting the delivery. It doesn't matter whether this process is computer-based or manual.
The transport company is responsible for proving the delivery of goods by Neudert. The receipt of each shipment must be documented by the name of the person receiving Neudert. If the consignment has not been accepted by one of the authorized persons (4.4), the consignment is considered "not delivered" and it is still the responsibility of the transport company to deliver this consignment to Neudert on time.
In addition, the freight forwarder enters himself in the "delivery and collection table" (see last page). The information required is: date, name, vehicle number, transport company, collection or delivery. Only if an entry can be found on this list has delivery to Neudert taken place. Without this entry, the shipment is considered "not delivered" and it is still the responsibility of the transport company to deliver this shipment to Neudert on time.

5. Pick-up (the transport company picks up the goods) 
5.1. Time of Pick-Up

The following pick-up times apply:
monday – friday: 07:00 – 9:00, 9:15 – 12:00 and 12:45 – 18:00

5.2. place for pick-up 

The place for pick-up is in the main building to the right of the large main entrance. Here is a double door with a bell for ringing.

5.4. Authorized persons

Employees of Neudert can be identified by the fact that they are wearing a gray Neudert shirt and have a blue transponder.
Only Neudert employees are authorized to hand over consignments to a transport company. Upon request from the carrier, each employee is happy to identify himself with his shirt and transponder. People who only have the gray shirt or only the blue transponder or neither of them are not employees of the Neudert company.
The transport company may not accept a Neudert shipment from any other person, whether inside or outside the company premises, even if they pretend to be employees of the Neudert company. This shipment is then the responsibility of the transport company and not Neudert.

5.5.Documentation of pick-up (handover of goods to the transport company)

Neudert uses the documents provided by the transport company to document the collection. If a transport company has no documentation (e.g. courier trips or taxi trips), Neudert prepares its own document. Every consignment is acknowledged, as the documents of the transport company provide.
Neudert is responsible for providing evidence of the transfer of goods from Neudert to the transport company.
If a transport company has received a consignment from a person who is not from Neudert, but has claimed to do so (5.4), the responsibility of this consignment lies with the transport company and not Neudert.
The transport company is responsible for the subsequent documentation of the transport and delivery of the shipment to the recipient. As part of the obligation to provide evidence, Neudert can provide this documentation on request (tracking, etc.).
In addition, the freight forwarder enters himself in the "delivery and collection table" (see last page). The information required is: date, name, vehicle number, transport company, collection or delivery. A pick-up from Neudert has only taken place if an entry can be found on this list. Without this entry, a shipment is obviously not from Neudert and the responsibility of this shipment lies with the transport company and not Neudert.

Note: 
– Place of delivery and place of pick-up are located a few meters apart from each other above the courtyard. 
– We reserve the right to redirect the items within the two locations.

6. Transport damage / Goods takeover

The transport company must ensure in all respects that the goods in good condition reach their destination

  • in the case of damaged goods, Neudert reserves the right to refuse acceptance at the expense of the transport company

  • the consignments are accepted subject to subsequent quality and quantity control

  • the carrier is only informed of the number of packages delivered (packages, pallets, packages, etc.)

  • The qualitative and quantitative incoming goods inspection takes place in the further course on the basis of the delivery note

  • The freight carrier must confirm obvious defects in the packaging and quantity deviations in the packages on the documentation

  • Hidden transport damage that is not recognizable when the goods are received will be reported to the transport company for settlement within a maximum of 2 working days

     

7. Exchange of pallets and loading aids

Neudert generally exchanges Euro pallets immediately. Only Euro pallets that can be exchanged are exchanged (see "EPAL quality classification" class A & class B, also class C to a certain extent), all other poorer or damaged pallets are not exchanged. Neudert accepts these, however, and generously disposes of them without incurring costs for the transport company.

If the pallets are not exchanged immediately, the pallet credit must be documented. Upon request from Neudert, the transport company will state the amount of the credit account. It is up to Neudert to demand this credit, the transport company will then deliver the Euro pallets in an appropriate time.
Noteworthy special or loaned containers must be noted on the delivery notes and explicitly reported when the goods are received.

8. Environmental Protection

Due to environmental protection and for the benefit of our neighbors, every stopped or parked car is exhibited in the yard. The driver's key must be removed from the vehicle.
The vehicles must be in reasonable condition. Liquids or gases such as oils etc. that have no business outside the vehicle must not escape.
In the interest of all of us, everyone certainly understands that Neudert would immediately inform the transport company if a case of pollution such as Oil stains appear on the floor etc. The polluter then has 24 hours to repair this damage.
After this time, Neudert will file a complaint in the interests of our environment and remedy the damage as quickly as possible. In the event of major damage, any costs incurred are passed on to the person who caused the damage. In the case of minor damage that Neudert can repair itself, Neudert allows itself to charge the perpetrator an expense allowance of € 70 per hour.

9. Security

For occupational safety reasons, it is mandatory for all carriers to wear safety shoes on the Neudert premises.
The vehicles of the transport company are in a safe condition and comply with the rules of the Road Traffic Regulations. This means, for example, that lights work, the tread depth of the tires is above the wear limit, appropriate winter tires are used in the winter months, TÜV and AU are in order, etc.
Neudert reserves the right to inspect the vehicle when goods are received or dispatched and, if necessary, to refuse this vehicle when dispatched. The transport company is informed at short notice and has the opportunity to remedy the situation accordingly.

10. Special Agreement

Special agreements that deviate from these delivery and pick-up guidelines must always be agreed in advance with the responsible employees of Neudert and specified in writing.

11. Failure to observe the delivery guidelines

If the above guidelines are not observed, Neudert reserves the right to notify the transport company of the recognized defect.
In the event of repetition, everyone certainly understands that Neudert will charge the transport company responsible for any expenses incurred for searching, rearranging, repacking, identifying or labeling, etc., in the amount of € 40 per hour.

12. Work without delivery guidelines

Neudert allows himself to identify the transport companies with whom a good and constructive cooperation can be sealed on this basis as a "partner company for transport" and to point out the high quality and reliability of these companies.
Shipments that are carried out with other companies are not the responsibility of Neudert. The client bears full responsibility for smooth transportation. Any costs incurred will be charged in full to the client or the transport company responsible.

13. Validity 

From February 2018, these guidelines will apply to all Neudert transport companies and self-deliverers.
All previous versions are no longer valid.
Neudert asks that these requirements be observed and implemented.
